Microfinance Boss Accuses Police Of Harassment, Intimidation

The Chairman of Atlas Microfinance Bank, Benedette Uzoamaka Obiajunwa, has cried to the High Court of Justice, over constant harassment by policemen attached to the office of the Inspector-General of Police.

According to Obiajunwa, through her counsel, Barrister Ifeanyichukwu Obasi-Nweze, the IGP Special Monitoring Team turned itself into a debt recovery agents contrary to a judgement of the Supreme Court that says the Police cannot act as a debt recovery agent.

According to a court document made available to LEADERSHIP, one Mr. Ignay Nwene, trading under the name NMA LULU UNO, secured a consent judgement sum of over N100m against Atlas Micro Finance Bank.

Out of the consent judgement sum, Mrs. Obiajunwa was able to pay about N50m while also pleading with Nweze to be patient with her so that she can raise money to pay up.

But Nwene, who claimed he ran out of patience used extra judicial means to intimidate and harassed Obiajunwa to pay him.

According to Barrister Nweze, the businessman engaged the IGP monitoring team to intimidate and harassed his client so as to recover his money which was against the law of the federal republic of Nigeria.

According to him, Supreme Court has settled it in one of its judgements that the police is not a debt recovery agent and cannot recover debt for anyone.

According to a motion on notice filed by Barrister Nweze, the consent judgement sum is only enforceable by the Deputy Sheriff of the high court and his officers in a manner directed by the court and not the Nigeria Police.

In an affidavit attached to the motion on notice, dated February 20, 2020, Obiajunwa said she was arrested, detained and tortured alongside her brother Joseph Amaechi Odenigbo, on the order of Ignay Nwene.

''That I am one of the applicants herein and I was arrested, detained and tortured by the 1st to 5th respondent at the behest of the 6th respondent (Ignay Nwene) from the 18th to 24th December, 2019 and since then the 1st to 5th respondent have been inviting me for them to keep me in their custody until they pay the consent judgement sum against Atlas Micro Finance Bank.

Respondent in the suit are the Nigeria Police Force, the Inspector General of Police, FCT Police Commissioner, Adamu Elena, ACP and Head, IGP Special Monitoring Unit, ASP Aminu Sokoto, IPO, Ignay Nwene and Deputy Sherrif, FCT High Court.

The case has been adjourned April 1, 2020.
