A legal practitioner, Ugochukwu Osuagwu Esq has called on the Senate to respect the doctrine of separation of powers and not to arbitrarily constitute itself into a court of law or usurpate the powers of the judiciary as clearly stated in the constitution.
Barrister Osuagwu was apparently reacting to a recent summon by the Senate, mandating the Chief of Army Staff to appear before its ethics and privileges committee on a petition file by one Lt. Col Mohammed who was dismissed from the Nigerian Army for abusing his office and carrying out actions considered to be at variance with the code of conduct for members of the Armed Forces in Nigeria.
The legal luminary in his reaction while speaking to newsmen said there is every likelihood that the Senate is not aware of its standing rules which bare her from interfering in issues before the court or is out to carry out start another war with the judiciary in its desperate attempt to override other arms of government.
He therefore condemned the summon purportedly issued to the Chief of Army Staff, Lt. General Tukur Yusufu Buratai, ordering him to appear before its committee for the purpose of discussing or investigating an issue before the National Industrial Court in order to make a mockery of the court and what lawyers are expected to do before the temple of justice.
Osuagwu added that the Senate must not be allowed on this wild goose chase against its own rules as stated in STANDING Rules 2015, where it was unequivocally stated that matters in Court must not be discussed before the plenary.
" We must do well to save this hallowed chamber from self destruction to quickly remind them that by the provisions of the STANDING RULES 2015 of the Senate, matters in court
are not allowed to be entertained by the SENATE. Yet the
Senate went ahead, usurping the powers of the Court and took
up a matter of Employee dismissal already before the
National Industrial Court."
"It is clear that the Senate on this ground does not have the
jurisdiction to hear the petition or even summon the Chief of Army Staff."
For the records LT.COL Mohammed had on August 12, 2016 filed
a suit in the National Industrial Court against the Chief of
Army Staff and the Nigerian Army seeking reinstatement. This
means the matter which the dismissed officer took to the Senate is
already in Court and sub judice. If the senate had done due
diligence it would have realized this long ago, " he added.
Osuagwu therefore charged the Senate to respect its boundary and allow the Court to do justice to the matter by expressly discharging itself of the powers to abdicate in this particular dispute.
President Muhammadu Buhari has appointed Mrs. Aishah Ahmad, as Deputy Governor of the Central Bank of Nigeria.
According to a statement on Thursday by his Special Adviser on Media and Publicity, Mr. Femi Adesina, the President had presented Ahmad to the Senate for confirmation.
Adesina said the woman would replace a former Deputy Governor, who retired early this year.
“In accordance with the provisions of Section 8(1) (2) of the Central Bank of Nigeria (Establishment) Act 2007, President Buhari urged the Senate President, Dr. Bukola Saraki, to consider the expeditious confirmation of Mrs. Ahmad, who would then resume work immediately,” the statement read.
The presidential spokesman added that Buhari had written the Senate, seeking the confirmation of appointment of members of the Monetary Policy Committee of the CBN.
He said the appointees were to replace four members, whose tenure expires at the end of this year.
“The nominees are: Prof. Adeola Festus Adenikinju; Dr. Aliyu Rafindadi Sanusi; Dr. Robert Chikwendu Asogwa and Dr.Asheikh A. Maidugu.
“After Senate clearance, the new members of the Monetary Policy Committee are to resume duties next January,” the statement added.
A banker and investment adviser, Ahmad has over 20 years certified experience with global financial institutions such as Stanbic IBTC Bank, Zenith Bank PLC and Bank of New York Mellon among others.

We BRIBED Lawmakers With N177m - Prof Benjamen Ogunmodede, DG of IAR&T Jailed For 40yrs Over Embezzlement

Former Director-General of the Institute of Agricultural, Research and Training, Prof Benjamen Ogunmodede, has said that he and two other persons convicted alongside him spent N177m to bribe lawmakers and some employees of the Federal Ministry of Finance.
Ogunmodede and two staff members of the IAR&T were, on Tuesday, sentenced to 40 years in prison without an option of fine by a Federal High Court sitting in Ibadan.
They were convicted of mismanaging funds meant for the payment of salaries and execution of projects in the school.
The other two convicted persons were the institution’s account staff members, Zacheus Tejumola and Adenekan Clement.
The three individuals were arraigned by the Economic and Financial Crimes Commission in 2011 on 16-count bordering on conspiracy, unlawful conversion, stealing of school subvention among others.
While giving the judgment, Justice Ayo Emmanuel said each of the convicted persons would spend four years for each of the charges they were guilty of, adding, however, that they would spend the jail term concurrently.
Ogunmodede and others were accused of diverting N177m out of a subvention of N600m released by the Federal Government for the school.
The sum (N177m) was said to have been spent without due process.
In their defence, the convicted persons claimed that a huge part of the money was used to bribe members of House of Representatives and some staff of the Federal Ministry of Finance who facilitated the release of the fund for the research institute.
But Justice Emmanuel ruled that Ogunmodede and others were clearly guilty of the charges preferred against them.
He said that bribery and money laundering were illegal activities that had been prohibited in the country and that they were punishable under the law.
The judge said the sentence would serve as deterrence to people in public position who might wish to mismanage public fund.
“We must have it in our mind that the primary reason for sentencing a guilty person is to serve as a deterrence to those with similar criminal tendencies and for rehabilitation of the accused.
“The two reasons are sociological in nature,” he said.
Ogunmodede’s counsel, Tunde Olupona, from the chambers of Rotimi Akeredolu, said the legal team would review the ruling and decide on the next step.
EFCC’s lead counsel, Nkereuwem Anana, said the judgment was an indication that the war against corruption was being won in the country, noting that the judgment would send a message to others who are mismanaging or embezzling public funds that the long arm of the law would one day catch up with them.
N283m Exam Budget Fraud: Edo axes perm sec, suspends 3 others

Edo State Government on Friday sacked a Permanent Secretary in the State Ministry of Youth and Special Duties, Dr. Osayuware Idahosa and three other civil servants over alleged engagement in fraud.
They were specifically accused to have allegedly padded the budget for the conduct of primary school examination to the tune of N283 million.
Dr. Idahosa who served as Permanent Secretary in the state Ministry of Education at the time the alleged fraud was committed, was referred to the State Civil Service Commission for appropriate action, according to the rules and guidelines of the service.
The decision was the outcome of an extraordinary session of the State Executive Committee meeting, headed by the Governor of Edo State, Mr. Godwin Obaskei, in Government House, Benin City.
The other officers involved in the alleged fraud are Mr. S. A. Erhunmwunse Edokpayi, Mrs. E.I. Ero-Ugiagbe and Mr. Lucky Adagbonyin.
The EXCO resolved that they should proceed on indefinite suspension without pay and their case forwarded to the State Civil Service Commission for appropriate actions according to the rules and guidelines of the service.
Recall that Governor Obaseki vowed to unmask the people that sent a N283 million request for the conduct of primary school examination in the state, which was eventually conducted at the cost of N30 million.
Speaking to journalists after the meeting, the Commissioner for Communication and Orientation, Rt. Hon. Paul Ohonbamu said that the Attorney General and Commissioner for Justice, Prof. Yinka Omorogbe, submitted a report on the panel of enquiry on the conduct of the 2016/2017 Primary School Leaving Certificate Examination and after due consideration of findings and recommendations, the EXCO took the decisions.
According to Ohonbamu: “EXCO also set up a committee to be chaired by the Honourable Commissioner for Employment and Wealth Creation, Hon. Emmanuel Usoh to investigate the delisting of about 350 private schools from the list of eligible schools to participate in the Primary School Leaving Certificate Examination and also the conditions that led to the relisting of these schools shortly after they were delisted.”
Other members of the committee include Ohonbamu and the Managing Director of Edo State ICT Agency, Mr. Lambert Ugorji.
Ohonbamu further said that the EXCO meeting ordered that an audit exercise be carried out on the accounts that pertain to the examination exercise, which has now been marred by alleged corruption. This audit will cover 2014, 2015 and 2016.
The Igbos And The The Foul Cry of Marginalization, By Okoi Obono-Obla

I don’t agree absolutely with the argument that the Igbos are marginalized in this country.
How can anybody contend that a formidable (in every sense of the word) group that is everywhere in the country are marginalized.
The Igbo have through dint of industry and hard work, enterprise become of the most formidable groups in Black Africa.
Do you know that the Igbo people owe almost 70 percent of the buildings in Abuja?
A group that produced the first president of this country, Dr Nnamdi Azikiwe (1963-1966) ; produced the first Military Head of State of Nigeria, Major General Johnson Aguiyi-Ironsi (1966); they produced first Vice- President of this country (1979-1983), Dr Alex Ifeanyichukwu Ekwueme; they had produced a military vice-president of this country, Vice Admiral Ebitu Ukiwe (27 August 1985-October, 1986) ; a group that had produced three Speakers of the House of Representatives of this country namely (Jaja Anucha Ndubisi Wachukwu (He was first Speaker of the Nigerian House of Representatives (1959-1960); Edwin Ume Ezeoke (1979-1983)! Igbo became Speaker of the Houser of Reprsentatives briefly in 1992 during the transition programme of General Ibrahim Babangida!
A group that had produced many Senate Presidents of this country including Dr Nnamdi Azikiwe (1960);Dennis Osadebey (1960-1963); Dr Nwafor Orizu (1963-1966); Evan Enwerem (199); Dr Chuba Okadigbo (1999-2000); Anyim Pius Anyim (2000-2003); Adolphus Wabara (2003-2005) and Ken Nnamani (2005-2007).
A group had produced Chief Judge of the Federal High Court Hon. Justice Rose Ukeje); a group that had produced the first President of the Court of Appeal, Justice Onuorah Ibekwe (1976-1978); a people that had produced numerous Justices of the Supreme Court of Nigeria including Hon. Justice Lious Nwanchukwu Mbanefo; Hon. Justice Charles Dadi Onyeama; Hon. Justice Dan Ibekwe;Hon. Justice Anthony Nnaemezie Aniagolu CON; Hon. Justice Augustine Nnamani CON; Justice Chukwudifu Akunne Oputa CON to mention but a few claimed that they are marginalized.
A people that had produced many Governors of the Central Bank of Nigeria including Paul Agbai Ogwuma (1st October 1993- 29 May 1999); Charles Chukwuma Soludo (29th May 2004-29th May 2009) and Godwin Emefiele(3 June 2014 till date).
In this present dispensation, the Igbos have Six Ministers, numerous permanent Secretaries; Directors; Director Generals, Ambassadors, Top officials in the Federal Civil Service, Abia State alone has the largest number of civil servants in the Federal Civil Service more than three Northern States put together; The Igbos have produced Army Chief of Staff, Maj Gen Johnson Aguiyi-Ironsi (general Officer Commanding the Nigerian Army from 1965-1966); Lt Gen Onyabor Azubuike Ihejirika (September, 2010-January 2014); Lt-Gen Kenneth Minimah (January 2014-July 2015);Chief of Naval Staff, Vice Admiral JD Ezeoba (2012-2013); Chief of Air Staff, Air Marshall Paul Dike ( 20 May 2006-20 August 2008); Air Marshall Paul Dike, Chief of Defense Staff ((20 August 2008-September, 2010); Mike Mbama Okiro (2007-2009) Inspector General of Police, Ogbonna Okechukwu Onovo, Inspector General of Police (2009-2010)! Numerous Ministers for the past 60 years! Produced four Comptroller Generals of Nigeria Immigration Service including JE Onubogu (1966-1967); Chukwurah Joseph Udeh (2005-2010); UC. Nwizu (2000-2004) and Rose Chinyere Uzoma (2010-2013) claim they are marginalized!
A group that just recently produced the Secretary to the Government of the Federation, Senator Anyim Pius Anyim (2011-2015); says they are marginalized!
Do you know that there are numerous ethnic nationalities in this country that have never produced a judge of the High Court or Court of Appeal or a Justice of the Supreme Court, member of the Senate, Member of the House of Assembly, director; a commissioner, Local government Chairman; a Senior Army Officer, a Senior Police Officer etc! Talk less of President, Vice President; Speaker of the House of Representatives, Senate President, Minister etc.
So who is marginalized in Nigeria! Let us discuss this nationality question once and for all!
Those who are horribly and truly marginalized are the more than 500 small ethnic nationalities scattered in the South/South; North Central; North West, North Eastern Regions of the country!
These are the people who should be crying for justice, fair play, affirmative action, not the three major groups including the Yoruba, Igbo and Hausa ethnic nationalities!
BIAFRA: FG Must Punish Criminals as it Addresses Genuine Argument for Restructuring

The Federal Government of Nigeria must immediately bring the weight of the law to bear on criminal elements that are hiding under agitation against marginalization to breach the constitution and the extant laws of the land even as everything must be done to address genuine concerns being expressed by those using the appropriate channels to demand restructuring.
This call became necessary following observation that many members of the terrorist group, the Indigenous People of Biafra (IPoB) have started migrating to other separatist groups that are becoming virulent and could soon continue acts of aggression from where IPoB stopped before the court ordered that it is a terror group.
The Biafra Zionists Federation (BZF) led by one Benjamin Igwe Onwuka, having been swelled in membership by defecting IPoB members, is now ramping up its purveyance of hate speech and incitement to violence in the fashion of the terrorist group. Onwuka, speaking as BZF leader, is calling for attacks on the Chief of Army Staff (COAS) - Lt. Gen Tukur Buratai and the Minister of Information, Alhaji Lai Mohammed, including threatening them with trial at the International Criminal Court on a shallow basis.
Onwuka, who clearly forgot that only those who have wronged the people will go to prison, must be reminded that history would acknowledge Alhaji Lai Mohammed and General Buratai as heroes especially in the way they discharged their sacred responsibility of upholding good governance in Nigeria and by extension in Africa.
Much as Onwuka's BZF and other miscreants are angry that the Nigerian Army has tamed them and prevented them from continuing to unleash mayhem on innocent citizens or to continue their regime of criminality, they must realize that no country gives free passes to terrorists, extremists, secessionists and separatists to oppress the law-abiding populations.
Onwuka, BZF, and other separatists have the penchant for pegging their ill-conceived demand on the notion that they can get other nations to interfere in the affairs of Nigeria.
This rabble must therefore be schooled to understand that responsible leaders deal head on with criminality irrespective of the barrage of propaganda and sponsored outcry by criminals and their backers. The United States under President Donald Trump banned nationals of eight countries from gaining access to that country; on September 27, 2017 eleven people were arrested across England and Wales as part of investigation United Kingdom's banned extreme right-wing group, National Action, which is just one of the many banned groups in that country.
We recommend the words of Detective Chief Superintendent Martin Snowden, the head of counter-terrorism policing in North East England, to the Federal Government, Biafra separatists and terrorists alike. Snwoden said of the arrests: "Those who promote extreme views are looking to divide our communities and spread hatred. This will not be tolerated and those who do so must be brought to justice."
The government of Nigerian and its military must therefore pay no heed to the shallow threats from misguided elements that think agitation for restructuring or secession confers immunity for breaking the law. Only those that make their case for restructuring through constitutionally sanctioned channels and processes must be given attention while law breakers should be dealt with as prescribed by law.

The dreaded Badoo cult group tormenting the Ikorodu Area of Lagos State and some part in Ogun State has been listed among other cult gangs why the Nigerian Military has said it would unleash the infamous Operation Crocodile Smile II.
The Army through it Director and Public Relation, Brig. Gen. Sani Usman on Wednesday made the disclosure in an interview with Punch Newspaper
The Army insisted that the military operations – Egwu Eke II and Crocodile Smile II – like the earlier operations, were not targeted at “any particular ethnic group or group of individuals.”
Usman said, “Let me tell you. I made reference to Operation Crocodile Smile, because there is so much mischief and misinformation in respect of Exercise Egwu Eke II. What we are saying is that the exercise is not targeted at any particular ethnic group or a group of persons.
“The army needs to train because in the event of being called upon by the civic authorities, we will know what to do. So, we are looking at large-scale security challenges and we train on those aspects. Last year, we had all these exercises based on the challenges at that time.
“But this year, there are issues associated with criminalities such as Badoo and other cult-related activities. The problems associated with the North-West are different from the South-South or the South-East or a combination of both. The whole idea is that these exercises are routine and some people only blow things out of proportion. But we mean well and we just want to train our troops to be more professional.”
