Saraki SUV Scandal: A national assembly officer wrote to customs claiming the car belongs to the “convoy of the senate”
Tokunboh Akindele, a car dealer whom the senate contracted to supply the seized Range Rover sport utility vehicle (SUV) , claims Senate President Bukola Saraki was not involved in the transaction.

He also said he did not know the customs documents issued to him were forged.

Akindele said this in an affidavit he swore to at the Lagos high court registry on January 25.

There has been a controversy over the seized vehicle reportedly owned by Saraki.

Sahara Reporters reported that the delivery driver had a TO WHOM IT MAY CONCERN letter from the national assembly liaison office in Lagos saying the car was for Saraki.


The site further reported that after the car was impounded by customs for underpayment of duty as well as having fake papers, one O. A. Ojo acting as the secretary of procurement, estate, and works of the national assembly, wrote to the service requesting the release of the vehicle which he said belonged to the convoy of the “senate”.

The controversy rippled when the upper legislative chamber summoned Hameed Ali, comptroller-general of the Nigeria Customs Service (NCS), to appear in uniform.

The customs had planned to enforce a retroactive collection of duty on vehicles, but the senate intervened, summoning Ali.

Although Ali appeared before the senate Last Thursday, he did so in civilian attire. He was ordered out of the chamber and was asked to re-appear in customs uniform on Wednesday. This subsequently led to a face-off.

However, the face-off spawned an allegation that the senate was exacting vengeance on Ali because the customs had seized Saraki’s SUV.

The senate is now investigating the allegation.

According to Akindele, the car dealer, the vehicle was purchased from Hizmark Inc – a car-dealing company based in the US.

He said the vehicle was delivered to him in Lagos in September 2015, but that it was impounded in January 2017 while it was being conveyed to Abuja.

“Sometime in 2014, I engaged the services of Hizmark Inc, a company registered in the United States of America to purchase two armoured Range Rover sport utility vehicle (the ‘cars’) and deliver them to me in Lagos,” he said in his affidavit.

“I received an invoice from Hizmark Inc with details of all the expenses to be incurred for purchasing and delivering the cars to me in Lagos and subsequently made payments towards the purchase of the cars and expenses to be incurred.

“Hizmark Inc informed me that the cars had been shipped and introduced me to one Mr Latif Olajide, a licensed and registered clearing agent in Nigeria in August 2015, whom it said would be responsible for paying all the applicable duties, clearing the cars at Tin Can Island Port, Lagos and delivering them to me.

“Mr Olajide cleared the cars and delivered them to me sometime in September 2015. Subsequently, I sold one of the cars to the Nigeria national assembly in January 2016.

“On 13 January 2017, I received a phone call from a representative of the Nigeria national assembly who informed me that the Nigeria Customs Service had impounded the car I sold to them on the grounds that the documents used in the clearing the cars were forged.

“I had no knowledge that the documents used in clearing the cars were forged before I sold the car to the national assembly, and I did not authorise any person including Mr Olajide to forge the documents required to clear the cars.”

Akindele also wrote a petition – dated 23 January – against Olajide, the clearing agent, to the inspector-general of police, urging him to investigate the matter.

On 15 February, the senate wrote to the car dealer, informing him that the vehicle, which was meant for the senate, was no longer needed.

“Kindly recall your recent complaints about your inability to retrieve the above vehicle (Range Rover black long wheel base, 2014 model) from the Nigeria Customs Service which is meant to be one of the official vehicles of the senate,” the letter signed by Ojo OA, secretary, procurement, estate and works (for the clerk of the national assembly), read.

“Despite our efforts to assist in retrieving same which failed to yield desired result, we are therefore, constrained to inform you that due to your inability to deliver within the time frame, the vehicle is no longer required.”

The senate president has already denied involvement in the importation of the vehicle.

Yusuph Olaniyonu, his special adviser, issued a statement on Tuesday, saying Saraki had no hand in the transaction.

A document, according to Sahara Reporters, retrieved from a driver who was driving an armored Range Rover car said to be worth N298million, has categorically clarified that the car belongs to Senate President Olubukola Saraki.

The car was seized by officers of the Nigerian Customs, according to regulations, kicking off a frenzied war led by Saraki against Hameed Ali, the Director General of Customs, with the Upper House demanding that Mr. Ali appears in uniform before it.  

The car, with chassis number “SALGV3TF3EA190243, was seized on January 11, 2017.   With a value of N298 million, our Customs sources said the duty on the car ought to be N74 million.


But speaking through spokesperson Yusuf Olaniyonu earlier today, Mr. Saraki tried to distance himself from the scandal.

He described as “outright falsehood” the allegation raised earlier by Senator Ali Ndume linking Mr. Saraki with the importation of the vehicle.  That forced the Senate, in Saraki’s absence, to refer the matter to its Committee on Ethics, Privileges and Public Petitions for investigation.  It is unclear what would have happened had Mr. Saraki been present and wielding the gavel.

It is noteworthy that the Senate President was absent because of his trial by the Code of Conduct Bureau on a slew of assets declaration charges.  

Sources told SaharaReporters that a document in the car, signed by a member of the staff of the Senate Liaison Office in Lagos, clearly shows that the vehicle was being driven to Abuja for the Senate President.

It was further learned according to Sahara Reporters that following the seizure of the vehicle by Customs officials, it was discovered that its paperwork had been forged to avoid paying duty on the car.  In addition, the vehicle had no end-user certificate, which is required of all armored vehicles imported into Nigeria.

Meanwhile, the Senate, on Tuesday, decided to investigate the allegation that an armoured Range Rover car said to worth N298m and seized by the Nigeria Customs Service belongs to the President of the Senate, Senator Bukola Saraki.

The move was based on a point of order raised by former Majority Leader of the Senate, Ali Ndume, who also called on the upper chamber of the National Assembly to investigate the allegation that Senator Dino Melaye did not complete his first degree in Geography at the Ahmadu Bello University, Zaria.

Also, the ABU management said it would issue a statement on Melaye’s academic status on Wednesday (today).

An online news portal, SaharaReporters, which made the allegation in a report published on March 18, 2017, said the seizure of the Sports Utility Vehicle, allegedly belonging to Saraki, was the reason why the Senate was moving against the Comptroller General of the NCS, Col. Hammed Ali (retd.).

The medium reported that the car was intercepted and impounded on January 11, 2017, by the service for allegedly having fake documents.

Ndume, at the plenary on Tuesday, said previous certificate scandals involving members of the National Assembly were probed by the lawmakers.

He said, “One has to do with the distinguished Senator Bukola Saraki, the Senate President, and it was reported in a paper; I have it here. With your permission, I will want to, after making presentation, lay it down. It says that, ‘Senate on Vengeance After Nigeria Customs seized Senator Saraki’s bulletproof Range Rover Over Fake Documents.’

“My colleagues that are following events, particularly online, have seen, heard or read the rain of abuses on this Senate and the misconception of the fact that we invited the Customs CG based on a very unpopular policy that affects the people we represent.

“During the 4th Assembly, Salisu Buhari was accused of certificate forgery; he was investigated and his fate determined. After that, in the 5th Assembly, Bello Masari was accused of certificate forgery (secondary school); it was investigated and was cleared. In the 6th National Assembly, Dimeji Bankole was accused of not having NYSC certificate; it was investigated and he had to show his NYSC certificate.

“Now, that brings me to the second matter. In the National Assembly, here in the Senate of the 4th Assembly, Enwerem was accused and it was also investigated. Wabara was accused of collecting a bribe and it was investigated and determined. So, a lot of precedence had been set. Now, the second matter of privilege affects my colleague, Sheikh Dino Melaye, and it is in The Punch of today (Tuesday) on Page 10; I have the newspaper. In The Punch, it says, ‘Dino Melaye in first degree certificate scandal.’”

Ndume also quoted an online medium with a report titled, ‘Dino Melaye Allegedly Did Not Graduate From University.’

He added, “Therefore, accordingly, I will appeal we refer the matter to the Ethics and Privileges Committee to investigate so that our colleagues would be cleared and this Senate will stand as it is supposed to.”

The Deputy President of the Senate, Ike Ekweremadu, who presided over the plenary, referred the matter to the Committee on Ethics, Privileges and Public Petitions, which was asked to report back to the lawmakers in four weeks.

Saraki, however, denied any link with the seized car.

The Special Adviser to Senate President on Media and Publicity, Mr. Yusuph Olaniyonu, in a statement, stated that  the allegation “lacks basis as it was outright falsehood.”

Olaniyonu said from the facts and documents about the seized vehicle, it was obvious that the Senate President had nothing to do with the importation of any vehicle.

He said, “A supplier was engaged by the Senate to supply a vehicle. While transferring the vehicle between Lagos and Abuja, it was impounded by the customs. We believe that is an issue between the supplier and the customs because the Senate has not taken delivery. So, why is somebody trying to drag the name of Saraki into the issue?

“The documents on the vehicle are there for the general public to view and make their conclusions. Now that the matter has been referred to the Committee on Ethics, Privileges and Public Petitions, all the facts will be out.”

Melaye, who is a member of the committee, in his reaction after the plenary, told journalists that he was ready to be probed. He also said he would suspend his membership of the panel pending the determination of the case.

He said, “I’m here to respond to the issue raised by the … senator of the Federal Republic of Nigeria, Senator Ali Ndume. I want to say, to me, it is a welcome development. Democracy is about investigation and no senator is above investigation. To me, it is a welcome development and it will finally clear the air on all the malicious and vindictive allegations.

“To say that I did not graduate from ABU is to say that I am not a senator of the Federal Republic of Nigeria. ABU is a very prestigious university in this country and it is not possible for one to be running a Master’s programme in the university when one did not graduate from a university. I have successfully completed one and I am doing the second one.

“I want to announce that this is the eighth degree that I am pursuing. I am also a graduate of the University of Abuja, where I did Master’s in Policy Analysis. I am a graduate of the London School of Economics and Political Science. I am also a graduate of Harvard University. The course I am pursuing now will make it my eighth degree.”

When asked what would happen to his membership of the panel directed to probe him, Melaye replied, “Definitely, in the interest of justice, I will excuse myself from the consideration of this matter except when invited for questioning.”

He added, “I have my admission letters, results, certificate of discharge from ABU. Not only that, I was the Student Union Government President of ABU. On three occasions, I was the most popular student on campus.”

However, the Information Officer of ABU, Mr. Adamu Muhammed, told one of our correspondents that the university would issue a formal statement on the status of Melaye on Wednesday (today).

He said, “We are gathering all the facts from the faculty and the department concern and we will issue a press statement tomorrow (today).”

The name of the erstwhile leader of the Senate, Ali Ndume, has reportedly been penciled down for suspension from the National Assembly by senators loyal to Senate President, Bukola Saraki, over what they have described as ‘unparliamentary’ utterances made by the Borno-born lawmaker.

Ndume incurred the wrath of Saraki and his loyalists, when he protested the rejection of the acting chairman of the Economic and Financial Crimes Commission (EFCC), Mr. Ibrahim Magu, by the Senate.


Ndume had said Saraki erred by accepting a new report not signed by the Director-General of Department of State Services (DSS), Lawal Daura.

Referring to a similar letter written to the Senate President by an Assistant Comptroller General of Nigerian Customs Service (NCS) on behalf of Col. Hameed Ali, Ndume had queried why Saraki declined to read the letter, but accepted a similar one from the DSS.

Ndume, after the second rejection of Magu, granted several press interviews where he openly criticized Saraki and the entire Senate for rejecting Magu.

A source familiar with the planned suspension of Ndume, told the media that the move may happen any time barring any last minute change of mind.

He also said that another senator, seen to be neutral, has been approached to move a motion on the floor of the Senate to that effect.

“Already, senators loyal to Saraki are already reaching out to other colleagues who are yet to join the train. Senator Dino Melaye is believed to be leading the offensive,” the source said.

Unperturbed by his planned suspension, Ndume called for the investigation of Saraki and Melaye over the face-off with the Comptroller General of Customs, Col. Hameed Ali (rtd) and certificate forgery allegation leveled against Melaye.

The name of the erstwhile leader of the Senate, Ali Ndume, has reportedly been penciled down for suspension from the National Assembly by senators loyal to Senate President, Bukola Saraki, over what they have described as ‘unparliamentary’ utterances made by the Borno-born lawmaker.

Ndume incurred the wrath of Saraki and his loyalists, when he protested the rejection of the acting chairman of the Economic and Financial Crimes Commission (EFCC), Mr. Ibrahim Magu, by the Senate.


Ndume had said Saraki erred by accepting a new report not signed by the Director-General of Department of State Services (DSS), Lawal Daura.

Referring to a similar letter written to the Senate President by an Assistant Comptroller General of Nigerian Customs Service (NCS) on behalf of Col. Hameed Ali, Ndume had queried why Saraki declined to read the letter, but accepted a similar one from the DSS.

Ndume, after the second rejection of Magu, granted several press interviews where he openly criticized Saraki and the entire Senate for rejecting Magu.

A source familiar with the planned suspension of Ndume, told the media that the move may happen any time barring any last minute change of mind.

He also said that another senator, seen to be neutral, has been approached to move a motion on the floor of the Senate to that effect.

“Already, senators loyal to Saraki are already reaching out to other colleagues who are yet to join the train. Senator Dino Melaye is believed to be leading the offensive,” the source said.

Unperturbed by his planned suspension, Ndume called for the investigation of Saraki and Melaye over the face-off with the Comptroller General of Customs, Col. Hameed Ali (rtd) and certificate forgery allegation leveled against Melaye.

According to Premium Times, the secrecy with which the National Assembly has handled its budgets, and the lopsided manner it distributes funds for zonal intervention projects, are unsettling the lawmaking body and putting members on a collision path against the leadership,


Recalls the ousted Senate Leader, Ali Ndume, had on January 10, challenged the Senate President, Bukola Saraki, to make the budget open, disclosing that he and his colleagues, like most Nigerians, had no knowledge of details of the NASS budget.

Such calls have grown in the last week, and have become even more intense in the House of Representatives which for most of last year was at the centre of a devastating budget padding scandal triggered by former appropriation committee chairman, Abdulmumin Jibrin.

Mr. Jibrin accused his former ally and speaker of the House, Yakubu Dogara, of inserting fictitious projects worth billions of naira into the national budget, an allegation the speaker denied.

Presently, lawmaker-colleagues are agitating for the House budget to be made open, and for a more equitable allocation of funds for so-called intervention projects, several lawmakers told confided in our source

Legislators, many of them principal officers, and administrative offices of the National Assembly, said the budgets of the Senate and the House were known only to the Senate President, the Speaker and the Clerk to the National Assembly.

“It’s so secret that neither the Senate Leader nor the House Leader knows what is in the (budget),” said one source.

Mr. Saraki, according to Premium Times has repeatedly failed to honour his pledges to make details of the N115 billion 2016 National Assembly budget public.


With N23.347 billion in 2003, the National Assembly’s budget now stands at about N115 billion yearly, representing over 492 per cent rise in 13 years.

Until 2016, the budget had often gone as high as N150 billion a year.

In 2010, when the budget hit a shocking record sum of N154.2 billion, David Mark, Mr. Saraki’s predecessor, decided to block Nigerians from knowing details of how the National Assembly’s jumbo allocations were spent. The policy especially concealed how much members earned in allowances.

In one masterstroke of legislative brinkmanship, the National Assembly under Mr. Mark, made itself member of an exclusive club of agencies whose are deducted en-bloc (first-line charge) via statutory transfers, without disclosures.

Apart from the money allocated for the National Assembly to fund its budget on first line charge, the body gets N100 billion for “zonal intervention projects”, commonly called “constituency projects”.

The Senate, with 109 members, takes 40 per cent of that amount, while 60 per cent goes to the 360-member House.

All the constituencies take share. But the sharing is so skewed that while a principal officer’s constituency gets projects that are worth over a billion naira, an ordinary member’s constituency may get a single project valued at N50 million.

“My constituency gets N38 million (for zonal project) in 2016,” said Aliyu Madaki, Kano lawmaker, who is amongst the members calling for reforms.

A previous investigation by PREMIUM TIMES showed that the constituency projects are at best a clever way of deceiving Nigerians, and at worst an outright theft of public funds.

While benefitting lawmakers are not paid directly, they and MDAs in which zonal projects for their constituencies are domiciled, are involved in an organized network whereby the legislators nominate through “letter of introduction” contractors who get contract awards from the MDAs.
In most cases, the contractors are predictably, fronts for members.
They pay “returns” to the lawmakers, and would therefore be at liberty to deliver a shabbily executed project.
The spokesperson for Mr. Saraki, Yusuph Olaniyonu, denied Senators were agitating for reforms of how zonal intervention fund is shared.


“There is nothing like that,” he said.
The spokesperson for the House, Abdularzaq Namdas, did not deny the agitation for reform but explained the rationale for the current sharing formula.

“The issue of zonal intervention projects has been like that for long,” said Mr. Namdas. “The money is shared among the zones; that’s why it is called zonal intervention. So, if you are from a large state with many constituencies, you are likely to get low allocation.”

The spokesperson meant that a lawmaker from Kano or Lagos for instance was going to get allocation far less than what will be due to one from Bayelsa State.
But a Senator, seeking anonymity, disagreed.

“That’s the explanation but it is just about convenience. Why? A principal officer irrespective of his state or zone get huge allocation for his constituency. I mean if that explanation is valid and consistent Gbajabiamila who is from Lagos, with many constituencies should get something like N50 million, but he got about a billion naira,” the Senator argued.

Similarly, even lawmakers in Mr. Dogara’s camp are not buying Mr. Namdas argument.

“Is it wrong,” asked Adekola Adekoya, Ogun State, rhetorically, when his comment on the agitation for reform was sought.
“It is not bad. We want equitable distribution. I have studied the Speaker closely. I am persuaded that the leadership of the National Assembly, especially the Speaker, is looking at the agitations.”

Compelled by the agitations, the Speaker, last week, set up a six-man committee to review the sharing of the zonal intervention funds, the votes and proceedings for Wednesday showed.

A lawmaker said the committee was set up by the Speaker to defeat the call for an executive session to discuss the agitations.

“No to zonal representation,” said Mohammed Soba, Niger State, stressing that all members should discuss the agitation.
Whichever way, Mr. Soba expressed expectation that outcome should be known “very soon”.

“That (outcome of the agitation) should be before the end of the budget process.”
Budget Disclosure  

The leadership of the House asked members to disregard allegations made by Mr. Jibrin, a source said.

“But members believe they don’t have what to use to defend themselves before their constituents against Jibrin’s allegations because they don’t know details of their own budget,” said the source, providing basis for the call for disclosure to members.

Yet, it appears the lawmakers are not “very” concerned about the disclosure as much as the agitation for zonal intervention reform.

Several lawmakers told PREMIUM TIMES that the National Assembly leadership, particularly the Senate President and the Speaker of the House of Representatives, use the budget to control lawmakers, tactically determining who gets what and when.

“Because most of us benefit from these allowances, it is really difficult to speak publicly against the leadership,” a member of the House of Representatives said.

Mr. Adekoya said he didn’t “totally” agree the budget was not known to the lawmakers.

He suggested there is possibility for the lawmakers to understand what the details of the budget are, using what they earn and use.

“If I am given N2, 000, I should be able to multiply that by 365 days. I know I use AC in my office. We have staff. There are directors and staff who are civil servants,” he said.

But the Reps’ spokesperson, Mr. Namdas, did not gloss over the secrecy around the budget. He said the leadership of the House had promised to disclose the details of the budget “not only to members but also to the public.”

A source close to Mr. Saraki said it was not as if the Senate President was not ready to disclose the NASS budget.

“But a lot of the lawmakers are not well disposed to it because they feel it will expose them to the public,” the source said.

Some insiders said many lawmakers do not care about knowing what is in their own budget, and are prepared to also stop the public from knowing, so long as their earnings keep coming.

Daily Trust - The Auditor-General’s report has exposed a N2 billion financial scandal in the National Assembly expenditure, according to document seen by Daily Trust.

The revelation came at a time the National Assembly has been under increasing pressure to make its budget expenditure open.

Details of the lawmakers’ annual budget of over $100 billion have been shrouded in secrecy since 2010.

The AGF’s annual report, exclusively obtained by our correspondent, said the illegalities were perpetrated in 13 transactions.

The transactions involved both chambers of the National Assembly, the Management as well as the National Assembly Service Commission (NASC), and the National Institute for Legislative Studies (NILS).


The report said House incurred the highest infraction of N1.1 billon followed by Management, N347.8 million; NILS, N246.5 milliion; the Senate N205.7 million; legislative aides N70 million and NASC,N30 million.

The annual report for 31st December 2015 was laid on the floor of the Senate on Tuesday by the Senate Leader, Senator Ahmad Lawan.
The Senate President, Bukola Saraki  referred it to the Senate Committee on Public Accounts for further legislative actions. The committee was given four weeks to look into the matter.

At the House, the Auditor-General observed that contracts for the purchase of 48 Units of Utility Vehicles were awarded to three contractors at N624 million 

The report stated that, “records however showed that the supply of 14 Units of these motor vehicles were not made. The Clerk has been informed and has been requested to recover monies paid for the outstanding 14 vehicles and forward the recovery particulars for audit verification.”

Also at the House, the Auditor-General said 50 cash advances amounting to N499.6 million were granted to staff to carry out various assignments.
 “However, as at the time of writing this report in August, 2016, more than a year after, the advances are yet to be retired.

“Some of the vouchers were granted multiple advances without retiring the previous ones in violation of the Financial Regulations which provides that no new advance should be granted, if the previous ones had not been retired” it stated.

The report said that the Clerk of the National Assembly had been requested to recover the advances from the affected officers and furnish the Auditor-General with the recovery particulars for audit verification.

For the Senate, the Auditor-General’s report said N186million  meant for the payment of Motor Vehicle Loan which was paid into a Commercial Bank Account as indicated in the mandate was misapplied for other purposes such as organizing Senate Retreat and Pre-Valedictory Session of the 7th  Senate.

This action, according to the report, violates the provision of Financial Regulations 417 which states that, “Votes must be applied only to the purpose for which money is provided. Expenditure incorrectly charged to a Vote shall be disallowed” 

The Clerk of the National Assembly has been notified and requested to explain reasons for the Violation of extant rule. He was also asked to recover the fund and forward the particulars for audit verification. 

Still on the Senate, it was observed that Bank Charges amounting to N15.9 million were charged for the period July to December, 2015.

“This is contrary to the provisions of e-Payment Circular  Ref no. TRY/A8/88/2008 which requires that individual benefits and claims should be effected through their personal Bank accounts.  Financial Regulations 734 also provides that ‘’ No Government Organization or Agency shall place government  funds in any Commercial Bank that will charge any commission on transactions “.

The Clark has been asked to recover the amount and furnish the Auditor-General with the recovery particulars for audit verification.

In the Management accounts, the Auditor-General said the personnel Account was overdrawn in two instances, and this attracted a penalty amounting to N8.8 million in violation of the provisions of Financial Regulations 710 which states that “No Government Bank Account shall be overdrawn or any temporary advance obtained from a bank and any bank charges incurred shall be recovered from the Accounting officer.”

The Clerk has been requested to pay back the money and furnish the Auditor-General with the payment particulars for audit verification.

It also observed that account payment vouchers amounting to N115.9 million paid by the Management within the first 6 (Six) months of the financial year 2015, were not produced for audit examination.

“Therefore, I cannot attest to them as proper charges against public funds. The Clerk of the National Assembly has been requested to produce the vouchers or recover the total sum under reference, and the particulars forwarded for audit verification,” it reads.

It was further observed that Cash Advances totalling N158million granted to members of staff in 17 instances between the months of January and June 2015 are yet to be retired at the time of writing this report in the month of August 2016, (more than a year after payments) in flagrant disregard of extant regulations which stipulate that all advances should be retired/accounted for, immediately after the completion of the assignment for which funds were granted.

The Clerk has been communicated that the defaulters should be sanctioned in line with the provision of Financial Regulation.
During the Audit of National Assembly Budget & Research Office (NABRO) account, financial scandal of N66million was observed. It said there was Vital/relevant supporting documents.

The Audit of the Personnel Accounts of the Legislative Aides revealed that a total sum of N78.5million was expended on the payment of Overtime/Special Allowances to officials who are not Legislative Aides, in the months of November and December 2015.

“This payment found to be irregular has been brought to the attention of the Clerk of the National Assembly. He should produce the enabling authority, otherwise he should return the sum of N70, 560,000.00 to Government Treasury and furnish Auditor-General with the recovery particulars for verification,” the report stated.

In case of the National Assembly Service Commission, an amount totalling N17million  was deducted from four months’ salaries by the commission in the year 2015 as PAYE (Pay As You Earn) and claimed to have been remitted to the Federal inland Revenue Services without any evidence of payment to FIRS.

“If evidence cannot be produced, then they said amount should be recovered and paid back to FlRS (and) furnish the Auditor-General with payment particulars for verification.”

At the NILS, it was observed that despite the prohibition of payments by cheque by the Federal government, except in extreme cases, the institute used cheque to make payment for transactions amounting to N246 million.

Saraki, Dogara's NASS In Fresh N2b Fraud
Daily Trust - The Auditor-General’s report has exposed a N2 billion financial scandal in the National Assembly expenditure, according to document seen by Daily Trust.

The revelation came at a time the National Assembly has been under increasing pressure to make its budget expenditure open.

Details of the lawmakers’ annual budget of over $100 billion have been shrouded in secrecy since 2010.

The AGF’s annual report, exclusively obtained by our correspondent, said the illegalities were perpetrated in 13 transactions.

The transactions involved both chambers of the National Assembly, the Management as well as the National Assembly Service Commission (NASC), and the National Institute for Legislative Studies (NILS).


The report said House incurred the highest infraction of N1.1 billon followed by Management, N347.8 million; NILS, N246.5 milliion; the Senate N205.7 million; legislative aides N70 million and NASC,N30 million.

The annual report for 31st December 2015 was laid on the floor of the Senate on Tuesday by the Senate Leader, Senator Ahmad Lawan.
The Senate President, Bukola Saraki  referred it to the Senate Committee on Public Accounts for further legislative actions. The committee was given four weeks to look into the matter.

At the House, the Auditor-General observed that contracts for the purchase of 48 Units of Utility Vehicles were awarded to three contractors at N624 million 

The report stated that, “records however showed that the supply of 14 Units of these motor vehicles were not made. The Clerk has been informed and has been requested to recover monies paid for the outstanding 14 vehicles and forward the recovery particulars for audit verification.”

Also at the House, the Auditor-General said 50 cash advances amounting to N499.6 million were granted to staff to carry out various assignments.
 “However, as at the time of writing this report in August, 2016, more than a year after, the advances are yet to be retired.

“Some of the vouchers were granted multiple advances without retiring the previous ones in violation of the Financial Regulations which provides that no new advance should be granted, if the previous ones had not been retired” it stated.

The report said that the Clerk of the National Assembly had been requested to recover the advances from the affected officers and furnish the Auditor-General with the recovery particulars for audit verification.

For the Senate, the Auditor-General’s report said N186million  meant for the payment of Motor Vehicle Loan which was paid into a Commercial Bank Account as indicated in the mandate was misapplied for other purposes such as organizing Senate Retreat and Pre-Valedictory Session of the 7th  Senate.

This action, according to the report, violates the provision of Financial Regulations 417 which states that, “Votes must be applied only to the purpose for which money is provided. Expenditure incorrectly charged to a Vote shall be disallowed” 

The Clerk of the National Assembly has been notified and requested to explain reasons for the Violation of extant rule. He was also asked to recover the fund and forward the particulars for audit verification. 

Still on the Senate, it was observed that Bank Charges amounting to N15.9 million were charged for the period July to December, 2015.

“This is contrary to the provisions of e-Payment Circular  Ref no. TRY/A8/88/2008 which requires that individual benefits and claims should be effected through their personal Bank accounts.  Financial Regulations 734 also provides that ‘’ No Government Organization or Agency shall place government  funds in any Commercial Bank that will charge any commission on transactions “.

The Clark has been asked to recover the amount and furnish the Auditor-General with the recovery particulars for audit verification.

In the Management accounts, the Auditor-General said the personnel Account was overdrawn in two instances, and this attracted a penalty amounting to N8.8 million in violation of the provisions of Financial Regulations 710 which states that “No Government Bank Account shall be overdrawn or any temporary advance obtained from a bank and any bank charges incurred shall be recovered from the Accounting officer.”

The Clerk has been requested to pay back the money and furnish the Auditor-General with the payment particulars for audit verification.

It also observed that account payment vouchers amounting to N115.9 million paid by the Management within the first 6 (Six) months of the financial year 2015, were not produced for audit examination.

“Therefore, I cannot attest to them as proper charges against public funds. The Clerk of the National Assembly has been requested to produce the vouchers or recover the total sum under reference, and the particulars forwarded for audit verification,” it reads.

It was further observed that Cash Advances totalling N158million granted to members of staff in 17 instances between the months of January and June 2015 are yet to be retired at the time of writing this report in the month of August 2016, (more than a year after payments) in flagrant disregard of extant regulations which stipulate that all advances should be retired/accounted for, immediately after the completion of the assignment for which funds were granted.

The Clerk has been communicated that the defaulters should be sanctioned in line with the provision of Financial Regulation.
During the Audit of National Assembly Budget & Research Office (NABRO) account, financial scandal of N66million was observed. It said there was Vital/relevant supporting documents.

The Audit of the Personnel Accounts of the Legislative Aides revealed that a total sum of N78.5million was expended on the payment of Overtime/Special Allowances to officials who are not Legislative Aides, in the months of November and December 2015.

“This payment found to be irregular has been brought to the attention of the Clerk of the National Assembly. He should produce the enabling authority, otherwise he should return the sum of N70, 560,000.00 to Government Treasury and furnish Auditor-General with the recovery particulars for verification,” the report stated.

In case of the National Assembly Service Commission, an amount totalling N17million  was deducted from four months’ salaries by the commission in the year 2015 as PAYE (Pay As You Earn) and claimed to have been remitted to the Federal inland Revenue Services without any evidence of payment to FIRS.

“If evidence cannot be produced, then they said amount should be recovered and paid back to FlRS (and) furnish the Auditor-General with payment particulars for verification.”

At the NILS, it was observed that despite the prohibition of payments by cheque by the Federal government, except in extreme cases, the institute used cheque to make payment for transactions amounting to N246 million.

According to Thebrief's Exclusive report, the Senate President Bukola Saraki is resolved to investigate the allegation of extortion labeled against the senate committee.

The committee had allegedly written to some local governments, demanding N400,000 from them for the award of “best-performing state”, a source confided in TheBrief .


The source said the senate president was peeved when he got wind of the allegation, and he vowed to launch an immediate investigation into the matter.

“The senate committee was accused of demanding money from some local governments for the award of best performing state,” he said.
“A governor had alerted the deputy senate president who informed the senate president. So, the matter will be investigated. 
” The senate president has zero tolerance for corruption. Although, nothing is confirmed yet, a thorough investigation will unravel those behind this.”
