Judiciary Bribe Saga: Fears Grips Ministers As almighty Kyari's Suspension Rumour Filters Amidst Imminent Cabinet Shake-Up

New Telegraph - Palpable fear has gripped some prominent members of the President Muhammadu Buhari’s cabinet, following rumours that the presidency might off-load them because of the weighty allegations leveled against some of them by two Supreme Court judges.

The apprehension came just as prominent Nigerians, including Constitutional lawyer, Ebun Adegboruwa; factional leader of Ohaneze Ndigbo, Chief Goddy Uwazuruike, and a former Secretary to the Benue State Government, Prof. Saint Gbilekaa, called on President Buhari to remove the Minister of Transport, Chief Rotimi Amaechi, and his Science and Technology Counterpart, Dr. Ogbonaya Onu, to enable them defend the weighty allegations leveled against them.



The fear was reinforced when it was observed last week that the Chief of Staff to the President, Abba Kyari, who was allegedly named in a N500million bribe over the fine imposed on the mobile telecommunication company, MTN, had been out of office for over two weeks. 

Presidency sources said a number of the ministers are jittery over the allegations and that one cannot rule out the possibility of a cabinet shakeup soon to remove some ministers who are said to have heavy baggage. 

A key government spokesman, who chose not to be named, said he could not confirm that, but that Kyari was on annual leave and would resume duties tomorrow.

Since the arrest of over seven judges by the Department of State Security (DSS), over allegations of corruption in the past three weeks, some of the judges have complained of victimization, witch-hunt and that evidence were planted in their apartment.

While Justice Sylvester Ngwuta of the Supreme Court alleged that Hon. Rotimi Amaechi begged him to pervert justice by canceling the governorship election in Ekiti State and order fresh election to favour his friend, Dr. Kayode Fayemi, Justice Inyang Okoro alleged that Amaechi also attempted to bribe him to influence the elections in Rivers, Abia and Akwa Ibom states. Similarly, Justice Ngwuta alleged that Dr. Onu invited him to his house and demanded that he influenced the outcome of the Governorship Election Appeal for Ebonyi State in favour of the Labour Party candidate in the state who had reportedly agreed to decamp to the All Progressives Congress

Whereas both Amaechi and Onu have denied the allegations, with the former describing it as “pure fiction, a dubious diversionary tale concocted to muddle the very serious issues of his (Ngwuta’s) arrest and investigations by the DSS,” President Buhari has been advised to, as a matter of urgency, drop those ministers and submit them from investigation. Constitutional lawyer, Ebun Adegboruwa, in an interview with Sunday Telegraph, said the current development was a fallout of the belief that even while in the opposition, the APC manipulated the judiciary to secure victory in many states, especially in the South.

“Governors Rauf Aregbesola, Adams Oshiomhole and Kayode Fayemi were imposed on Osun, Edo and Ekiti states respectively by the courts, and not through the ballots,” he said.

He noted that the manipulation by the APC, which was a beautiful bride of the judiciary over the years, have now boomeranged because the party could no longer have its way, adding that it only shows the APC as “an agglomeration of propagandists and political opportunists who took Nigerians for granted and took advantage of PDP’s poor performance to hoodwink Nigerians to vote for them” “I believe that the judges could not have cooked up the allegations against Amaechi and Onu, especially since the former is gradually becoming the Mr. Fix it of this administration. My submission, therefore,  is that if the indicted judges are to step aside, the indicted ministers should also step aside,” he said.

He stated that the current development was akin to the manner the Senate President, Bukola Saraki, and his Deputy, Ike Ekweremadu, were intimidated and charged to court for alleged forgery until they stood their grounds and the Federal Government beat a retreat by withdrawing the charges against them.

While he said corrupt judges have no business in the temple of justice, Adegboruwa added that the constitutionally approved organ, “the NJC, should be allowed to remove them, not the APC, not the DSS and definitely not Amaechi.” Uwazuruike in an interview with Sunday Telegraph, said the allegations against the ministers are weighty and the said ministers “should step aside for thorough investigation,” in order not to make a mockery of the anti-corruption war and the ‘Change Begins with Me’ programme.

“If you look at the Justice Ngwuta’s allegation, he was very pointed, telling the Chief Justice of the Federation: ‘My Lord, may I recall one morning when I pleaded not to be on the Panel of Rivers Governorship Appeal? My Lord, you said I was already on the panel and asked me why I made that request to be excluded.

When I explained what transpired the previous night, Your Lordship said Amaechi had also attempted to influence other justices,’ that means that the CJN was aware of the issue right from the beginning.

“Amaechi and the Chief of Staff to the President, who has been named in one or two cases of corruption, should be asked to step aside and thorough investigations carried out on this matter,” Uwazuruike said. He added, “This battle is against the independence of the judiciary. Since 1999, there had been attempts to deal with the judiciary.

The then President Olusegun Obasanjo tried it and you remember that there was a time the Supreme Court was burgled. That is the point I am making.” Gbilekaa said the President needs to show greater seriousness with the war on corruption by ensuring that prominent members of the APC accused of corruption are probed.

“He should also probe other non-PDP members. People have mentioned Rotimi Amaechi, his Minister of Transportation; Babatunde Fashola, the Minister of Works and Housing and several other names.

Of course, people who say the Buhari’s anti-corruption war is lopsided are quite right; we are not blind; we have eyes and we are seeing. So, as Nigerians, we know what is happening, it is one sided. Corruption should not be a party alphabet,” he said.

The convict was jailed for being in possession of cocaine.


“But the Federal High Court judge met with the convict and expressed regrets for wrongful conviction.

“He said he knew that the convict was a victim of a set up and his conscience was troubling him.

“He offered to assist the convict in whatever manner to make his stay in prison comfortable.

“But security agencies have picked up the visit of the judge and they have started investigating it.”

Premium Times - The National Judicial Council has said that it will not ask the judges accused of corrupt practices to step down as it has no powers to do so.

The NJC stated this on Friday in response to the demand by the President of the Nigeria Bar Association, Abubakar Mahmoud, that the seven judges arrested for corruption last week be asked to step down pending when they are cleared or found guilty in court.


In its response signed by its acting director of information, Soji Oye, the NJC said it Mr. Mahmoud’s advice “is unacceptable to the NJC; as it breaches the 2014 Revised Judicial Discipline Regulations formulated by NJC pursuant to Section 160 of the 1999 Constitution of the Federal Republic of Nigeria, as amended.

The NJC also said Mr. Mahmoud was present when it took an earlier position condemning the raid of the judges’ homes by the State Security Service, SSS, a fortnight ago.

Others are Justices V.N Agbata of High Court, Anambra, U. Ononogbo of High Court Abia, Nnamdi Dimgba of Federal High Court and Umar Nasir Gumi of High Court, Zamfara.

Probe panels have been set up by the council to handle each of the cases.

The judges, who would soon get their summons, were listed for probe after preliminary investigation confirmed a prima facie case against them, while the panels will begin sittings in about a fortnight.

Meanwhile, The President of the Nigerian Bar Association, Mahmoud Abubakar (SAN), on Thursday urged the National Judicial Council to order the immediate stepping down of the seven Justices accused of judicial fraud.

The NBA had earlier condemned the invasion of the Judges.

Abubakar gave the advice at the valedictory session in honour of Justice Sotonye Denton-West of the Court of Appeal in Abuja.

For days now, the country’s judiciary has come under criticisms over fraud allegations brought against the seven senior judicial officers.

They included two Justices of the Supreme Court and five Justices of the Federal High Court.
Abubakar said: “I am sure that many here will be expecting me to make further statements on the ongoing events affecting the nation’s judiciary.

“I have in the course of the last two weeks or so made several statements and remarks on these developments. Our position is therefore well known.

“It appears to the NBA that it is extremely important that the NJC takes very urgent steps to safeguard the public image and sanctity of the courts.

“We therefore strongly recommend that, without prejudice to the innocence or otherwise of the Judges involved in the ongoing investigations, they should be required to excuse themselves from further judicial functions.

“Better still, they may be required to proceed on compulsory leave until their innocence is fully and completely established or until the conclusion of all judicial or disciplinary proceedings.

“We believe this will be necessary in order to protect the sanctity and integrity of judicial processes that may involve the judges concerned and safeguard the public image of the institution.”

A fresh report emanating from Vanguard Newspaper suggests that the Federal Government, yesterday, shunned the National Judiciary Council, NJC, and pressed ahead with its decision to bring the seven suspected corrupt judges to justice. The seven are among the 15 already identified by the Department of State Services, DSS, and the Economic and Financial Crimes Commission, EFCC, but the other eight are yet to be named and invited for questioning.

The NJC, which claimed to have omnibus powers over both criminal and administrative matters relating to judges in Nigeria, last week, disregarded the Presidency’s directive to suspend the suspected corrupt judicial officers from duty, pending the trial and disposal of the criminal allegations levelled against them.


Rather than comply with Presidency’s order, the NJC slammed the DSS for daring to search the homes of the judges in the night and making away with huge cash in local and foreign currencies. Although none of the suspects denied keeping the huge cash in their homes, the NJC was silent on the propriety of the discovery of the money in the homes of the judges but disparaged the DSS for the raid, which it claimed was intended to cow the judges from doing their jobs. In a brazen move to get at both the NJC and the suspects, who have tried to blame key ministers in Buhari’s administration for their ordeal, the Federal Government, last night, formally approved the prosecution of the suspects with immediate effect.


A top Presidency official confirmed to Our source that the Office of the Attorney General of the Federation, AGF, had approved the immediate prosecution of the suspects so as not to give the erroneous impression that government was promoting corruption. The top source said the trial of the suspects would be carried out in phases and handled by the National Prosecution Council, which was recently inaugurated.

The source said the refusal of the NJC to suspend the suspected judges was interpreted as a ‘slap’ on the Presidency and that no country would allow a few people to constitute themselves into a cabal that is ‘above the law’. Asked to disclose the nature of the charges to be preferred against the judges, the official said: “The charges are generally for corruption, with an isolated case of illegal possession of firearms to be pressed against one of the judges.”

‘The firearms were recovered from the home of one of the suspects by the DSS during the nocturnal raid on October 7, a development that had sparked national outrage.’ Giving further insight into the trial, the source hinted: “I can tell you that the National Prosecution Council will lead the prosecution of the suspects, while the Director of Public Prosecution in the Federal Ministry of Justice will coordinate the team.

“The charges were cleared from the OHAGF only yesterday and the suspects are certainly going to be charged to court any moment from now. The Federal Government is not deterred by the refusal of the NJC to suspend the suspects from office.” Efforts to speak with the Attorney General of the Federation, Mr. Abubakar Malami, a Senior Advocate of Nigeria, proved abortive, as he was said to be outside Nigeria. None of his officials claimed knowledge of the approval of the charges against the suspected judges.

It will be recalled that the DSS had launched a sting operation in the homes of the judges on the night of October 7, 2016, recovering local and foreign currencies worth N360 million. Two of the judges are from the Supreme Court, while the rest sit in Federal and State High Courts. While Justice John Inyang Okoro of the Supreme Court claimed on Tuesday that $38,000 found in his home was his estacode, he did not say how the over N3 million cash was left in his home and not the bank.

On the other hand, Justices Ademola Adeniyi and Nnamdi Dimgba have blamed their ordeal in the hands of the DSS on the AGF over certain court verdicts they claimed they gave against him in the past. Nonetheless, the allegations against Malami were not mentioned to anyone until the raids on their homes by the DSS.

“The charges were cleared from the OHAGF only yesterday and the suspects are certainly going to be charged to court any moment from now. The Federal Government is not deterred by the refusal of the NJC to suspend the suspects from office.” Efforts to speak with the Attorney General of the Federation, Mr. Abubakar Malami, a Senior Advocate of Nigeria, proved abortive, as he was said to be outside Nigeria. None of his officials claimed knowledge of the approval of the charges against the suspected judges.

It will be recalled that the DSS had launched a sting operation in the homes of the judges on the night of October 7, 2016, recovering local and foreign currencies worth N360 million. Two of the judges are from the Supreme Court, while the rest sit in Federal and State High Courts. While Justice John Inyang Okoro of the Supreme Court claimed on Tuesday that $38,000 found in his home was his estacode, he did not say how the over N3 million cash was left in his home and not the bank.

On the other hand, Justices Ademola Adeniyi and Nnamdi Dimgba have blamed their ordeal in the hands of the DSS on the AGF over certain court verdicts they claimed they gave against him in the past. Nonetheless, the allegations against Malami were not mentioned to anyone until the raids on their homes by the DSS.

The US FBI Had 3 Times Arrested ‘Corrupt’ Judges Too  Like Nigeria's DSS
TheCable - Just like the Department of State Services (DSS) arrested some judges for alleged corruption last Friday, a cursory check of possible instances shows that the Federal Bureau of Investigation (FBI) – the closest thing to Nigeria’s DSS – has a history of acting in like manner on judges.

The DSS raided the homes of some judges across country, claiming it recovered huge wads from them. The secret police arrested some of them.

Some of the judges the DSS arrested are Adeniyi Ademola and Nnamdi Dimgba (federal high court), and Slyvester Ngwuta and John Okoro (supreme court).


Ademola is the judge handling the trial of Sambo Dasuki, former national security adviser (NSA), who is being prosecuted by the DSS for alleged illegal possession of firearms and money laundering.

The judge has been critical of the DSS owing its refusal to release Dasuki after he had granted him bail.

Dimgba has also criticised the DSS for its high-handedness.

The DSS claims it is on a mission to sanitise the judiciary.

A debate now rages over the propriety of their action.

But here are three instances from the world’s “greatest democracy”.

JANUARY 2013

On January 31, 2013, the FBI arrested nine judges for “conspiracy to commit wire and mail fraud, wire fraud, mail fraud, perjury, making false statements to the FBI, and aiding and abetting”.

One of the judges, Willie Singletary, was seen in a video meeting with a motorcycle club called the Philadelphia First State Road Rattlers, saying: “There’s going to be a basket going around because I’m running for Traffic Court judge, right, and I need some money. I got some stuff that I got to do, but if you all can give me $20 you’re going to need me in Traffic Court. Am I right about that? … Now you all want me to get there, you’re all going to need my hook-up, right?”

Some of the accused judges — who were on the bench between 2008 and 2011 — are William Hird and Michael Sullivan.

They faced hundreds of years in prison.

NOVEMBER 2015

On November 4, 2015, the agency arrested a superior North Carolina court judge for bribery and corruption.

The judge,  Arnold Jones II allegedly attempted to bribe an FBI agent for information on what he described as a “family matter.” He faced about 37 years in jail.

Prosecutors said he approached the unidentified FBI officer in October 2015, and the two subsequently met in Goldsboro to exchange $100 for a disk supposedly containing the text messages.

Jones initially offered to give the officer “a couple cases of beer” for his help but later agreed to $100 in cash.

MAY 2014

Also, on May 30, 2014, it arrested a superior Puerto Rico court judge for bribery.

Manuel Acevedo Hernandez, the judge, was accused of accepting bribes to pervert the cause of justice in a fatal drunk-driving case. He was detained at his home after the FBI concluded its investigation.

The 62-year-old was detained at his home in the northwestern coastal town of Aguadilla.

The indictment also charges that the judge agreed to acquit Lutgardo Acevedo Lopez, a certified public accountant, in exchange for help in being promoted to appellate judge and to find employment for two of relatives.

“In my 35 years of experience, I’ve never seen anything like this,” US Attorney Rosa Emilia Rodriguez said at the time.

The judge pleaded not guilty and received a $50,000 bail.
