Premium Times - Despite promises during the campaigns in the build up to the 2015 election, President Muhammadu Buhari has failed to inaugurate the National Council on Public Procurement, NCPP, as required by Nigerian law.

The Public Procurement Act 2007 was signed into law by late President Umaru Yar’Adua on June 4, 2007.


The Act provides for the establishment of the National Council on Public Procurement, NCPP, and the Bureau of Public Procurement, BPP, as the regulatory authorities responsible for the monitoring and oversight of public procurement as well as harmonizing existing government policies and practices.  The act was put in place to put more transparency in and ensure public participation in government procurement.

Membership of the council according to the Act should comprise 12 members to be appointed by the president.

While six of the members are government officials, the other six are drawn from relevant professional organisations.  Those from the government side, considered permanent members, include the Minister of Finance, who serves as chairman, and the Director General of the BPP as secretary.

Others are the Attorney General of the Federation and Minister of Justice, the Secretary to the Government of the Federation, the Head of Service, and the Economic Adviser to the President.

Those representing professional bodies are drawn from the Nigerian Bar Association, the Nigerian Institute of Purchasing and Supply Management, the Nigeria Chamber of Commerce and Industry, Mines and Agriculture, the Nigeria Society of Engineers, a representative of civil society organisations and that of the media.

NOT ONLY BUHARI

Although President Yar’Adua signed the Act into law in his first week in office, he however, failed to set up the council until his death in May 2010.

His deputy and successor, Goodluck Jonathan, who eventually served as president for five years also failed to inaugurate the council.
As a result, most of the functions of the council were carried out by the Federal Executive Council, FEC.

The FEC is made up the president, the vice president, all the ministers and some presidential advisers; meaning the president and his political appointees who are all less likely to question his decisions.

The inability of the government to set up the council has meant the FEC approves contracts to be executed by its members.

Mr. Buhari had in a document circulated during the 2015 campaigns titled ‘ My covenant with Nigerians’ promised to “inaugurate the National Council on Procurement as stipulated in the Procurement Act so that the Federal Executive Council, which has been turned to a weekly session of contract bazaar, will concentrate on its principal function of policy making”.

Although the president after assuming office disowned the document, a PREMIUM TIMES fact check showed the ruling All Progressives Congress did author it.

The document was authored by the policy and research directorate of the APC presidential campaign, headed by current Minister of Solid Minerals Development and former Governor of Ekiti State, Kayode Fayemi, when the party was trying to convince Nigerians to abandon the then ruling PDP.

COUNCIL COMING SOON

A top official of the APC administration who declined to be named because he is not permitted to speak to the media on the matter said the issue of NCPP ” just like other boards and parastatals will be set up at the right time.”

The official said he is aware the office of SGF is working on the composition of the boards of parastatals.

He however, said, “the truth is government has a lot more important matters to attend to at the moment and the issue of procurement council and all others will be attended to in due course.”

Several efforts to speak with the SGF, Babachir Lawal, were unsuccessful. Calls to his mobile phone could not be connected. He also did not respond to our text message at the time of publishing this story.

Presidential spokesperson, Garba Shehu, however, promised to “make inquiries and revert” to us. He said the administration is “working on it”.
In reaction to the failure of the Buhari administration to set up the council, lawyer Jiti Ogunye said it is unacceptable for successive administrations to fail to inaugurate the NCPP.

He said the inability of the Buhari administration to inaugurate the council has ” grave consequences” because the Act establishing the council was not meant ” to be observed in breach”.

“The executive is not at liberty to choose which law it could implement. It is not a discretionary matter,” he said.

Mr. Ogunye said both the federal and state governments are charged under Section 5 of the Nigerian constitution 1999, as amended to “govern the country and execute all the laws passed by the National Assembly”.

The human rights lawyer said he could not say if the actions of the FEC to carry out the functions of the NCPP is illegal because there is no legal pronouncement on the matter.

He said the best way to resolve the controversy is through “public interest litigation seeking an order of mandamus” asking the Nigerian government to ” do what the law says they should do”.

Mr. Ogunye said the NCPP is the citizens only chance to participate in the procurement process in the country.

“The business of the Federal Executive Council is to deal with policy issues. It is not a contract awarding body,” he said.

We need a court declaration to say the FEC “as a substitute to the NCPP is illegal, unlawful and unconstitutional. On the basis of arguments, we can say what they are doing is illegal, but there is no legal declaration to that effect.”

A former Attorney-General of the Federation and Minister of Justice, Mr. Mohammed Bello Adoke (SAN), yesterday faulted the charge of alleged involvement in a $1.6billion Malabu Oil deal against him by the Economic and Financial Crimes Commission (EFCC), saying his involvement in the oil deal was ordered by former President Goodluck Jonathan, The Nation Newspaper reports

He said although the charge was irrational, he was prepared to make himself available to defend it at the appropriate time.

He said he did not benefit in any way from the auctioning of Oil Prospecting Licence 245(OPL 245), popularly referred to as Malabu Oil Block.


Adoke, in a statement, said he got requisite approvals from the former President Goodluck Jonathan to broker the settlement and execute the OPL 245 Settlement Agreement.

The statement reads: “My attention has been drawn to the charges filed by the EFCC against me and other named individuals and companies in respect of OPL 245 Settlement Agreement involving Malabu Oil & Gas Limited and Shell Nigeria Ultra Deep Limited.

“The charge of aiding the commission of money laundering offences preferred against me has finally confirmed the orchestrated plans to bring me to public disrepute in order to satisfy the whims and caprices of some powerful interests on revenge mission.

“I wish to reiterate that I acted within the actual and ostensible authority of the office I occupied to broker a settlement between Malabu Oil & Gas Limited and Shell Nigeria Ultra Deep Limited in order to ward off the over $2billion liability in damages for breach of contract which the country would have been exposed to in the likely event of the success of Shell Nigeria Ultra Deep Limited’s claim before the International Centre for the Settlement of Investment Disputes (ICSID).

“The Terms of Settlement ensured that the interests of the Federal Government of Nigeria, Malabu Oil & Gas Limited and Shell Nigeria Ultra Deep Limited were duly acknowledged and provided for in the Settlement Agreement.

“The Federal Government of Nigeria was entitled to the Signature bonus which was duly paid; Malabu Oil & Gas Limited surrendered its title to OPL 245 for a consideration and Shell Nigeria Ultra Deep Limited was re-allocated OPL 245 which it had previously substantially de-risked in consideration for withdrawing their over US$ 2billion claim for breach of contract against the Federal Government of Nigeria.”

Adoke gave more insights into why the Jonathan administration executed the Settlement Agreement.

He added: “Since the Parties aforementioned, faithfully discharged their respective obligations under the Settlement Agreement, one cannot comprehend how the Office of the Attorney-General of the Federation which brokered the Settlement was expected to renege from the agreement by denying Malabu Oil & Gas Limited the benefits associated with the relinquishing of their title to OPL 245 already warehoused in a joint FGN/Shell Escrow account, or to prevent the subsequent re-allocation of the relinquished OPL 245 to Shell Nigeria Ultra Deep Limited when the company  had already furnished consideration for it to the Federal Government of Nigeria.

“I am of the respectful view that it should be clear to any person dispassionately reviewing the transaction to confirm that I had no personal interest in the transaction; I did not take any benefit from it, I had requisite approvals from the President and Commander in Chief of the Federal Republic of Nigeria to broker the settlement and execute the OPL 245 Settlement Agreement.



“I am therefore unable to rationalise the charge of aiding the commission of money laundering offences preferred against me by the EFCC.  But be that as it may, I hope to at the appropriate time make myself available to defend the charges for what whatever its worth.”

The undated video, which was uploaded on YouTube on Tuesday, showed several soldiers surrounding three of their colleagues who they alleged fainted due to lack of food and water.

One of the soldiers explained that over 70 soldiers fainted due to lack of water, adding that they had spent up to three days at their location without water and food.

Another soldier begged that their message should be passed to President Muhammadu Buhari, suggesting it would be wrong for them to perish for lack of water after surviving Boko Haram

The video led to outrage among those who viewed it with several of them describing the situation pathetic and sad.

Similar scenario played out during the administration of the for President, Goodluck Jonathan.

The administration of President Muhammadu Buhari has so far recovered a total of N288.6 billion of looted funds in the previous regime of ex-President Goodluck Jonathan,, the Director-General of Budget Office, Ben Akabueze has revealed

This was even as the Minister of Budget and National Planning, Udo Udoma has allayed fears over the non approval of the Medium Term Expenditure Framework, MTEF by the National Assembly before the presentation of the 2017 budget estimates last week. 

Similarly, the Minister of State for Budget and National Planning, Zainab Ahmed also admitted that the Social Intervention Scheme otherwise called N-Power jobs piloted by the Federal Government has not performed fairly well. 


The officials spoke while fielding questions from Journalists at the 2017 Budget Breakdown organized by the Ministry of Budget and Planning at Old Banquet Hall of the Presidential Villa, Abuja yesterday. 

Akabueze said: “A total of N288.6 billion. This includes N97.6 billion which is equivalent of ‎$220 dollars expected from the swiss, part of what is called Abacha loot recovery. 

Then it also includes N72 billion that has already been received in recent cases of loot recovery. And a balance of N90billion. “Other expected recoveries that are at an advanced and reasonable stage that we feel comfortable and confident that they would come through in 2017 and so they have been reflected in the budget.” 

Udoma on his part said that the National Assembly which already had both the MTEF and the budget would work on them at their own pace. He also underscored the determination of the government to pull Nigeria out of recession. 

He said: “With respect to the question about the MTEF, the national assembly has the MTEF which has been updated. And they have the budget, so everything is with them. So, they will determine how they treat it. I am sure the sequence will be they do the MTEF before they do the budget. But everything is with the national assembly. “We are determined to bring succor to our people. 

The only way is by taking strong actions to change the current trajectory of the Nigerian economy. To get out of the recession and bring the country back on the path of growth, government must find the resources to spend on infrastructure, and to spend to reflate the economy”. 

On his part, the Minister of State for Budget, Ahmed said that the social intervention programme encountered teething problems even as she believed that the issues would be completely solved in the 2017 budget to meet the objective of the scheme.


SHOCKER: Obanikoro 'REARRESTED', Implicated In Fresh N450m Ex-President Jonathan Poll Fraud

There may not be end in sight so soonto many troubles bedeviling a former Minister of State for Defense, Senator Musiliu Obanikoro as the Economic and Financial Crimes Commission on Wednesday brought him back to its custody and quizzed him for several hours over fresh allegation of receipt of N450m from the Coordinator of the Goodluck Jonathan Campaign Organisation in Lagos State, Adewale Onilere, during the countdown to the 2015 presidential election.

According to Punch Newspaper, the N450m was part of the N23bn ($115m) allegedly disbursed to the leaders of the Peoples Democratic Party in the 36 states of the federation by a former Minister of Petroleum Resources, Diezani Alison-Madueke.

An EFCC source revealed that Onilere, who is the Chairman of the PDP in the Somolu Local Government Area, received N650m from the campaign organisation out of which N450m was given to Obanikoro.

He said, “Onilere received N650m and then delivered N450m to Obanikoro at his house. Onilere gave Obanikoro the money in the presence of some PDP leaders.

 “So, on Wednesday, we invited Obanikoro to tell his side of the story. However, Obanikoro denied receiving any money from Onilere.

“Since Obanikoro is currently on administrative bail, we let him go. However, we have invited Obanikoro and Onilere to come to our office in two weeks’ time to face each other. Surely, we will get to the bottom of this.”

In a terse text message, however, Onilere denied handling stolen funds.

“It is certainly false and I know nothing about it. Thanks,” he said.

Obanikoro and his two sons, Babajide and Gbolahan, are currently under a separate investigation involving N4.7bn which was allegedly diverted from the Office of the National Security Adviser.

The ONSA, under the leadership of the then National Security Adviser, Col. Sambo Dasuki (retd.), was alleged to have paid N4.7bn into the bank account of a company, Sylvan McNamara, in which Obanikoro’s sons were directors.

Obanikoro had said in his statement on oath at the EFCC that after receiving the money in June 2014, he gave N1.219bn to the then governorship candidate of the PDP in Ekiti State, Mr. Ayodele Fayose; while N1.3bn was given to the PDP candidate in Osun State, Senator Iyiola Omisore.

He also confessed to giving Fayose a separate $5.377m at Spotless Hotel in Ekiti State in the presence of party stalwarts including the then Ekiti State PDP Secretary, Mr. Tope Aluko.

Obanikoro was said to have kept about N785m for himself, which he allegedly spent while campaigning ahead of the PDP governorship primary in Lagos State, which Mr. Jimi Agbaje won.

However, the EFCC asked him to return about N584m of which he has already returned N137m.

APC Picks Jonathan's Ex-Minister As New National Spokesman Today

It was gathered that a former Sports Minister, Bolaji Abdullahi, from Kwara State, was being tipped for the job.

News Punch had since October 25th published that the ex-minister has been picked to replace Alhaji Lai Mohammed, who had resigned from the position to take a ministerial appointment from President Muhammadu Buhari's Government.


Bolaji Abdullahi, an indigene of Kwara State served as Minister of Sports under former President Goodluck Jonathan. He is also said to be a stooge to the Senate Presdent, Bukola Saraki.

The embattled Deputy National Publicity Secretary, of the party, Timi Frank, tried but failed to act in that capacity.

He has taken the party to court when it announced that he has been suspended.

It was however gathered that the leadership of the APC had concluded the plans to elect another spokesman from the North-Central geopolitical zone, with Kwara State emerging the preferred candidate.

The source said Abdullahi might emerge the new spokesman for the APC at a mini-convention expected to hold at the New Chelsea Hotel, Abuja at 11am.

It was also confirmed that delegates from only the six states of North-Central would attend the convention, while the Senate President, Dr. Bukola Saraki, members of the National Working Committee as well as governors from the states were billed to attend the convention.

Jonathan, who ruled Africa’s most populous nation from 2011 to 2015, lost his bid for reelection in last year’s presidential polls to President Muhammadu Buhari of the All Progressive Congress (APC).


Since leaving office Jonathan’s profile internationally has risen, and Mr. Momodu says the Peoples Democratic Party (PDP) chieftain may stage a comeback bid in 2019.

In an article titled, “The second coming of Goodluck Jonathan”, Mr. Momodu explained that the victory of US President-elect Donald trump “should bring us back to our senses”.

He wrote, “I have been reading about the rising profile of our former President, Dr Goodluck Ebele Jonathan, and wish to state without equivocation that no one should rule him out of the 2019 presidential race. I first hinted this possibility about two months ago and wish to reiterate that Nigerians should prepare for the shock that awaits us. The story of Donald Trump should bring us back to our senses. Nothing is impossible. The second coming of Goodluck Jonathan may be so far-fetched or even belong in those categories of impossibilities but I wish to plead with our government and my fellow citizens not to rule it out. As one of those who made our modest and humble contributions to the coming of this Buhari government, I’m pleading with trepidation.

Mr. Momodu blamed the ex-president’s rising profile on the failure of the government to maintain “the economy it met”.

He said, “Nigerians would have been ready to enter fire with Buhari. But there are just too many unresolved problems and challenges. The excuses that Jonathan and company left this peculiar mess behind has refused to fly.”

The business magnate said that the expectation of Nigerians who voted massively for the ‘change’ preached by the APC  during its campaign are “confronted with the reality of an economic recession they never planned for; a situation they did not experience under the Jonathan administration and under previous governments”.

He said, “The BBC reported on Friday how Jonathan caused a stir in Sokoto State during his visit to the state to pay his respects to Ibrahim Dasuki, the late former Sultan of Sokoto. According to the report, Jonathan was received by a large crowd of admirers, some holding banners bearing the words “Come Back Baba Jonathan”.

“The same voices that chanted “Sai Baba” and “Jonathan Must Go” are now fiddling with the tunes of the possibility of a Jonathan to stage a comeback. Here lies the irony of political triumph and the paradox of high expectations.

“The euphoria and momentum that saw the exit of Jonathan and the emergence of the Buhari change administration has since begun to wane following the inability of the new government to hit the ground running with the tenacity of a government in a hurry!

“There are many who believe that the poor management of the ensuing economic recession didn’t help matters. Suddenly, Nigerians who had high hopes and voted massively for change are now caught in a limbo between confusion and uncertainty.”
