Why Justice Ademola, Wife Acquittal Judgement Is Perverse, Appellate - Okoi Obono-Obla

The Special Assistant To President Muhammadu Buhari on Prosecution, Chief Okoi Obon-Obla has described the acquittal of corruption case against Justice Adeniyi Ademola and wife as a perverse judgment, and hence, can be appealed.

A High Court in Abuja has cleared Justice Adeniyi Ademola and his wife, Olabowale, of charges of corruption brought against them by the Attorney General of the Federation.

Mr. Ademola, a judge of the Federal High Court, was among the judges arrested last October in a late night raid by the State Security Service.

He was eventually charged by the attorney general’s office for, among others, allegedly receiving bribes during the discharge of is duties.


Mr. Ademola had requested a speedy trial of his case before he was cleared of any wrongdoing on Wednesday by Justice Jude Okeke.

in reaction to Just Okeke's judgement, the SA to President Muhammadu Buhari, Obono-Obla in a statement made available to the media said it was a miscarriage of justice

His words;

"I, vehemently disagree with the ruling by Honourable Justice Jude Okeke of the High Court of the Federal Capital Territory; Abuja acceding to an application for no case submission made by the defendants and dismissing the charges against Justice A.F.A Ademola and his wife."

"I think the ruling with due respect is perverse for a number of reasons. One of the reasons why I am of the view that the ruling is appealable is that the learned trial Judge , Okeke J in his ruling (which he read for almost four hours) went outside the ambit and purview of what a ruling in a no case submission is supposed to be."

"Inexplicably and surprisingly, Okeke J gave a lengthy ruling and even went as far as to evaluate evidence than rather circumscribing himself as to whether or not the prosecution had made out a prima facie case which the defence can answer."

"Indeed Okeke J gave a judgment not a Ruling which is out sync with the principle governing a no case submission."

"After a no case submission is made, the trial court ought to give Ruling not a judgment. If at the close of the evidence in support of the charge it appears to the court that a case is not made out against the accused sufficiently to make a defence the court as to that particular charge discharge him."

"What is a no case submission? A no case submission means that from the evidence adduced by the prosecution, the accused has no case to answer and should not therefore be called upon to defend himself and accordingly there is before the court no legally admissible evidence linking the accused with the commission of the offence"

"A no case submission is provided by Section 303 (1) of the Administration of Criminal Justice Act, 2015."

"Section 303 (1) of the Administration of Criminal Justice Act, provides that where the defendant or his legal practitioner makes a no case submission in accordance with the provisions of this Act, the Court shall call on the prosecutor to reply."

"Section 303 (3) of the Administration of Criminal Justice Act stipulate that the Court in considering the application of the defendant under section 303, the court shall in the exercise of its discretion, have regard to the following thus:

(a) Whether an essential element of the offence has been proved;
(b) Whether there is evidence linking the defendant with the commission of the offence with which he is charged;
(c) Whether the evidence so far led is such that no reasonable court or tribunal would convict on it
(d) Any other ground on which the court may find that s prima facie has not been made out against the defendant for him to be call upon to answer."

"The pertinent question is thus: Did the trial Judge take into account the conditions or factors enumerated in section 303 sub-section 3 of the Administration of Criminal Justice Act?"

"My answer is NO!"

Corruption takes place and manifest in many forms! It seems to me that some Nigerians love corruption and the message of this government that corruption is a canter worm which must be eradicated has not caught any ice to some people! This is why some people want some of us that are in public service to steal or illegally enrich ourselves and then behave like Robbins Hood, and distribute the proceeds of corruption and graft to members of the public in the guise of charity or to buy popular acclaim or political support! 

These crop of people wrongly believed those of us who have political appointments have the liberty to dip our hands into the public till and remove money and give to all and sundry. They wrongly believe, public appointment is passport to wealth, so every public servant must be wealthy! They do not know that public service is community service; not an avenue to make money at the expense of the community.



It is a sacrifice. Under this government, any public servant who live above his or her income by buying trailer loads of rice to distribute or dole out money ceaselessly to people is a candidate for EFCC arrest and detention! Any public service who lives ostentatiously is a thief, no more no less  ! Public servants cannot take money budgeted for roads, electricity, schools, universities etc and distribute to constituents under the cloak of charity! 

The road to salvation is discipline, hard work and industry! Self-reliance! We must all try to do something to earn a living! Dependency and paternalism, which some people think that public servants should indulge in, out of political correctness have become a relic! This is nothing but the truth ! Living by the moment will not take anywhere! 

If I give money to you today to take care of your needs for the moment or the day, and there is no guarantee that I will be able to give you something to take care of your need for another day; what is the point?  

We cannot continue to live by the moment! It is not sustainable! Sustainable living is living every day of your life! Any politician that encourages instantaneous or momentous living just to play to the gallery,  is a wicked one who must be shown the way out! 

Do any exert pressure on public servants to give you money they do not have! Do not make demands on public Appointees to dole out money because they are equally suffering from lack of resources otherwise, you are pushing them to cut corners or steal money that is budgeted by government for provision of schools, electricity, water, and other social amenities! 

Our young people should use the education they have acquired to go into entrepreneurship.  They must go into agriculture. They should stop seeing farming as self-demeaning.  It is better to be a farmer than being a slave or a root to one stupid politician!  They should stop waiting for some politicians to empower them. They must empower themselves using the education they have acquired because education itself is empowerment.

Cross River State chapter of the All Progressive Congress, APC has frowned at the Senate sudden removal of Chief Okoi Obono-obla from the list of cleared nominees into the board of the Nigerian Communication Commission (NCC).

It will be recalled that Obono-obla, the Special Assistant to President Muhammadu Buhari on Prosecution was nominated along seven others in August for confirmation by the Senate as Non-Executive Commissioner representing South South in the governing board of the NCC.

The Senate, in a plenary session on the 17th of November cleared Obono-obla along four others and dropped two nominees. But in a new twist, the Senate in a letter signed by the Senate President and sent to President Buhari removed Obla's name from the list of confirmed nominees.


But Obla's state party leadership  in a statement signed by it Publicity Secretary, Mens Ikpeme described the move by the Senate as "legislative rascality" and vowed that the party organ in the state and national will do everything to reclaim the mandate.

"All progressives Congress (APC) Cross River state seriously frowns at the rumours of an evil attempt making the rounds that the appointment of one of our party chieftain; chief Obono Okoi Obla as a non executive Commissioner of NCC has been suspended.

"The party leaders in the state and National are on top of this abnormal and crucial matter. We Will get to the Root of this seeming Selfish and  legislative rascality.

"The state party organ hereby  advise all our party faithfuls to remain calm and go about their normal businesses".

President Muhammadu Buhari's Special Assistant On Prosecution at the Ministry of Justice, Chief Okoi Obono-Obla, today pledged prompt legal assistance in prosecuting offenders to the Nigeria Security and Civil defense Corps, NSCDC.

The Calabar Chief,  a lawyer and renown human rights activist, Obla made the declaration at the office of the Commandant General, Abdulahi Gana Mohammed during a courtesy visit to the commission's headquarters in Abuja today.

The Commandant, during his welcome address, thanked the President's Legal aide for choosing to pay him the visit in the first place. He assured Obla that the command is prepared to work with the "Change Mantra" of President Muhammadu Buhari. He also assured the SA that the command will do everything possible to enhance communication between his office and the office of the SA to the President and Attorney General of the Federation.

Gana Mohammed also reiterated that his command is ready to fight in tandem with the President's vision in fighting against corruption and other acts of indiscipline. He said this to buttress the fact that his command does not need a big budget to enable it fight against corruption and other acts. But that the government should enhance better treatment of staff of NSCDC. He concluded that government should ensure that there is an enabling working environment to areas his staffs are posted to.

The SA to the President replying to the Commandant, assured the Commandant that his office will do everything possible to enhance the pathways through which the command can easily access interventions that will aid their smooth operations. He encouraged the SA on Legal Matters to the Commandant to send memos to his office to enable him forward same to the Attorney General or the President as the case may be. 

Obla assured the Commandant that all serious cases against the highly placed individual in the society will soon commence. He urged the Commandant to have faith in the National Prosecution Coordination Committee for a thorough job very soon.

He also advised the Commandant to look for interventions to support its maritime operations in order to enhance the efforts of the Nigerian Army in the fight against the Niger Delta insurgents.

Chief Obla was later taken to supervise the ongoing digital surveillance equipment of the command centre. 

Obla was happy that ongoing operations in the Niger Delta Region can be watched live through CCTV cameras and unmanned drones here in Abuja.

Why I will Not Join Senator Florence Ita Giwa's Advocacy Campaign On Bakassi, By Okoi Obono Obla

In a response to my statement titled ‘’The Hypocrisy of Senator Florence Ita Giwa on Bakassi’’ which was published on National Dailies across the country last week, Senator Giwa made an appeal to me to join her advocacy campaign on Bakassi. 
However, I want to state categorically clear that I will not mar my integrity by supporting the inglorious self-seeking advocacy of Senator Florence Ita Giwa on Bakassi on the following grounds: 

1. I perceive Senator Florence Ita Giwa’s campaign on Bakassi to be insincere, deceitful, opaque, and steeped in self-glorification;

2. Until Senator Florence Ita Giwa render an account of her stewardship as the Chairman of Bakassi Re-Settlement Committee, vis-a-vis media reports of missing funds which she there after requested the Economic and Financial Crimes Commission to investigate in an interview she granted the Galaxy Television on the 25th May 2010;

3. Until the former Governor of Cross River State , Mr. Donald Duke renders an account of more than N9 Billion that was given to the Government of Cross River State by the Federal Government of Nigeria in 2006 to re-settle the people of Bakassi affected by the implementation of the Green Tree Agreement between Nigeria and Cameroon;


4. Until the former Governor Liyel Imoke render an account of the money given to the Government of Cross River State by the Federal Government to ameliorate the effect of the loss of Bakassi Peninsula by Nigeria to the Republic of Cameroon, and the loss of 76 Oil Wells by Cross River State to Akwa Ibom State sequel to the Judgment of the Supreme Court of Nigeria.

5. Until Senator Florence Ita Giwa render a frank and honest disclosure of the role played by her office during the Bakassi saga. Despite her luscious position as a Senator of the federal republic, who was influential, resourceful and powerful and a Senior member of successive PDP controlled Federal Government, Presidential Adviser , 2003-2007, Member of the Board of the Nigeria Port Authority and Chairman of Bakassi Resettlement Committee.

6. Until senator Florence Ita Giwa renders an account of how much was contributed by the public and private sectors to her charity campaign for the Bakassi Children Foundation.
I also crave her indulgence to answer the following questions:

1. Where was Senator Giwa when Obono-Obla started his advocacy campaign on Bakassi on the 28th of October, 2002. When he wrote an editorial opinion in the Guardian Newspaper of 28th October, 2002 titled Bakassi; Matters Arising;

2. What was the contribution of Senator Florence Giwa to the case filed by Honourable Bassey Ita ; Honourable Effiong Edet Effiong; Samuel Asuquo and Prince Edem Nsa (for themselves and on behalf of all the Communities in Bakassi Local Government Area of Cross River State affected by the ‘Green Tree Accord’ between the Federal Republic of Nigeria and the Republic of Cameroon against the Federal Government of Nigeria; Attorney General of the Federation; Attorney General of Cross River State; Independent National Electoral Commission and Cross River State Independent Electoral Commission. and his associates in 2007 in the Federal High Court, Calabar in Suit No. FHC/CA/CS/13/2007; a case which I handled (as Counsel to the Plaintiff) pro bono;

3. Why did Senator Florence Ita fail to use her influence as a Senior Member of the PDP to get the former Governor, Senator Liyel Imoke to support the case? ;

4 Is Senator Giwa (as an unofficial adviser to Senator Imoke) aware that the Cross River State Government did everything humanly possible to defeat the Plaintiffs in that case?
