Recalls News Punch yesterday culled from The Nation Newspaper of a certain senator the EFCC has launched an investigation into a fraudulent N4 billion contract and 20 bank accounts, Senator Peter Nwaoboshi representing Delta North has opened up himself saying it was him the EFCC investigating, but claims it all about a vendetta.

It was also reported the senator allegedly used a firm to purchase a 12-storey building in Apapa, Lagos belonging to the Delta State Government at the cost of N805 million.

It was reported that the records at the Code of Conduct Bureau (CCB) showed that the senator failed to declare all the companies and bank accounts despite being operational prior to the time he made the declaration.


A source said that the investigation of the senator followed a petition from Delta State.

The petitioner, the report said, alleged that the senator owns a firm which was awarded a N1,580,000,000 contract by the Direct Labour Agency to supply construction equipment.

The petitioner also claimed that the senator through his firm allegedly secured  contracts from nine local governments areas in Delta State when the firm was yet to be registered under the Company and Allied Matters Act.

The petitioner was said to have alleged that the senator used proceeds from the contract to acquire several choice property in Lagos and Delta states, one of which is the 12-storey building  in Apapa, Lagos.

But Senator Nwaoboshi told reporters in Abuja that the claims of the EFCC were all lies aimed tarnishing his image.

The lawmaker said that there was no fraud in the execution of a N2.1billion contract awarded his company, Biderberg Enterprises Limited, by the Delta State Government in 2010.

Nwaoboshi, who is chairman, Senate Committee on Niger Delta Development Commission (NDCC), also refuted the claim that he fraudulently acquired a12-storey building belonging to Delta State in Apapa, Lagos in collaboration with his younger brother, Augustine Nwaoboshi.

He insisted that the whole allegations bordered on vendetta against him by the EFCC based on his recent position and the position of the Senate on the confirmation of the Acting Chairman of the EFCC,, Ibrahim Magu.

Nwaoboshi said: “Why is the EFCC coming up against me now  over contracts diligently and transparently executed seven years ago by my company, if not for misplaced vendetta that cannot in any way silence me or compromise my principled stance over some salient national issues before the Senate .

”Delta State government that awarded the contract is not complaining or any notable stakeholders in the state.

”So what interest is the EFCC serving over the matter when nobody from the state had raised any issue bordering on corruption as far as the contract is concerned or the 12-storey building bought in Lagos by one of my companies which was not undervalued as being alleged .

”Even the other issue reportedly raised by the EFCC as regards multiple bank accounts by my brother is ridiculous because there is no law in the land that limits the number of bank accounts any individual in the society should have.”.

The visibly angry senator noted that the signatory to such multiple bank accounts allegedly owned by his junior brother was not his, as being alleged by the EFCC.

He wondered why “the EFCC rushed to the press to spread falsehood against him without any need to interface with me and my brother as practised worldwide as far as investigation is concerned.

He said: “No doubt, with what I’ve read in the papers against me from the EFCC, Magu is at it again, but unfortunately for him, this cannot silence me to back out of the Senate’s collective decision against his confirmation and let me add that as a lawyer of 27 years, Magu and his cohorts shall definitely meet me in court”.

APC Senators Stage A Walkout As Saraki's Senate Cohorts Speed Up Amendment of CCB Act To Quash Trial

Few All Progressives Congress Senators, from Southwest today reportedly staged a walkout as Senate President, Bukola Saraki's contracted cohorts hastily commence the amendment to the Conduct Tribunal and Bureau Act, Senator Solomon Olamilekan Adeola representing Lagos West Senatorial District claimed.

According to Senator Olamileka Adeola, popularly known as Yayi, he and some of his unnamed colleagues staged a walkout in protest against the amendment to the anti-corruption bill. Though he was quick to the bill will sail through as the minority have no say at the Senate.

"I am sure many of you might have read that the bill to amend the Code of Conduct Act passed the second reading on the floor of the Nigerian Senate today with deputy senate president Ike Ekweremadu presiding."

"Even though majority in the senate will always have its way, I and the people of Lagos West Senatorial District are not in support of the amendments to the Code of Conduct Act CAP C15 LFN 2004 bill, which was sponsored by Senator Peter Nwaoboshi."

"I and some of my colleagues staged a walkout in protest of this," Senator Olamilekan was quoted to have posted on facebook.



Meanwhile, A bill for an amendment of the Code of Conduct Tribunal and Bureau Act scaled second reading at the Nigerian Senate, Thursday, just 48 hours after it was first read.

In Nigeria’s lawmaking process, rarely do bills get such accelerated legislative action.

The bill, sponsored by Peter Nwaoboshi (PDP-Delta State), passed second reading and was subsequently referred to the committees on Judiciary and Ethics, Privileges and Public Petitions.

The committees is to report back in two weeks.

THE AMENDMENT

The bill seeks to amend Section 3 of the Code of Conduct Bureau and Tribunal Act “to give every public officer appearing before the Bureau fair hearing as provided for under Section 36 (2)(a) of the CFRN 1999 which provides:

“For an opportunity for the person whose rights and obligations may be affected to make representations to the administering authority before that authority makes the decision affecting that person.”

The existing law, Mr. Nwaoboshi said in his lead argument, does not provide for the Bureau (CCB)to take written statement from concerned public officers before referring a matter of alleged non-compliance to the Tribunal (the CCT).

Mr. Nwaoboshi’s bill therefore proposes that before a public officer is accused of breaching the Code of Conduct law and referred to the Tribunal, the officer should first be allowed to make a statement in writing.


That is the crux of Mr. Saraki’s argument against his ongoing corruption trial at the Tribunal. He repeatedly asked that the case against him be dismissed since he was not invited by the CCB to give a written statement.

The amendment bill also seeks to stop the CCT from using the Criminal Procedure Act and the Criminal Procedure Code as a procedural template.
The bill was supported by several lawmakers who yelled “hai” when the Deputy Senate President, Ike Ekweremadu, put the question.
There was silence when the “nay” question was put.

Senators – Dino Melaye, Jibrin Barau, Abu Ibrahim, Abiodun Olujimi, Samuel Anyanwu – spoke in favour of the bill.

FUELLING PUBLIC SUSPICION

The bill, along with another one by Isah Misau (APC-Bauchi State), which seeks the amendment of the Administration of Criminal Justice Act (ACJA) 2015, was read for the first time on Tuesday.

The bill seeking an amendment of the ACJA 2015 wants the provision of the Act not to “apply to a Court Martial and such other Courts or Tribunal not being courts created and listed under Section 6 (5) of the Constitution of the Federal Republic of Nigeria 1999 as amended.”

In essence, if passed the ACJA amendment bill will make the usage of the criminal justice law illegitimate for the Code of Conduct Tribunal.
It was also slated for second reading Thursday but was stepped down, and its consideration fixed for a later date.

The two bills were introduced at a time the Senate President Saraki is facing trial at the Code of Conduct Tribunal with prosecutors relying on the two laws for which amendments are now being sought.

The senators’ action has fuelled suspicion that the amendments are being vigorously pushed to help the Senate President stave off conviction.
The haste at which the amendments are being rushed such as slating them for second reading within 48 hours has further fueled public suspicion.

The two amendments were sponsored by two of Mr. Saraki’s staunchest supporters, Messrs. Nwaoboshi and Misau.

A Senator of the All Progressives Congress from Kebbi State, Abdullahi Yahaya, raised that point in plenary, saying the timing of the amendments would remain a subject of suspicion, although he did not oppose the action.

But Deputy Senate President, Ike Ekweremadu, said the amendment was not meant to favour Mr. Saraki.

“The amendment is not to affect the current CCT trial in which the Senate President is involved,” he said.

He maintained that the amendment would in no way benefit Mr. Saraki since his trial started last year before the effective year – 2016 – of the proposed law.
He said the Senate only summoned courage to ensure justice for everyone.

Also justifying the amendments, Mrs. Olujimi said, “If you don’t assist your neighbour when his house is burning, it will extend to yours.”
